These terms govern your use of filosstays.com (the “site”). Please read them. By using the site, you agree to them. If you don’t agree, please don’t use the site.

1. Who we are and what these terms cover

This site is operated by Filos Stays LLC, a Kentucky limited liability company (“Filos Stays,” “we,” “us,” and “our”). We provide full-service short-term rental management for property owners in Kentucky.

These Terms of Use cover your use of the site itself — reading our pages, booking a call, and submitting our forms. They don’t cover the management of your property. That’s a separate matter, described in Section 3.

The “last updated” date above tells you when these terms last changed.

2. No advice, no offer, and no guaranteed results

The site is here to tell you about how we work and to start a conversation. It is general information, not advice and not a promise.

  • Nothing on the site is financial, tax, legal, investment, or accounting advice. For decisions about your property and your situation, please rely on your own qualified professionals.
  • Our commitments describe how we work — not a guaranteed return. Where we name a specific number or make a specific commitment, we mean it as a description of our service, not as a promise of any particular revenue, occupancy, or financial outcome.
  • Any estimate is an estimate. If we share a property analysis, projection, or estimated figure, it’s a good-faith estimate based on the information available at the time. Real results depend on things outside our control — market conditions, seasonality, your property, regulations, and guest demand — and will vary.
  • Nothing on the site is an offer. Using the site doesn’t commit us to manage your property, or to any particular pricing or terms. Those are set only in a signed agreement.

3. Using the site doesn’t create a management or brokerage relationship

Reading the site, booking a discovery call, or submitting a form does not create any agency, brokerage, employment, fiduciary, or property-management relationship between you and us.

We begin managing a property only under a separate written management agreement that both you and we sign. Until that’s signed, we have no obligation to you and you have none to us beyond these terms.

Filos Stays, LLC is not a licensed real estate brokerage. Activities requiring a Kentucky real estate license are performed under the supervision and on behalf of Covenant Realty, LLC, a licensed Kentucky real estate brokerage, by Michael K. Kimble, a Kentucky-licensed real estate sales associate affiliated with Covenant Realty, or other affiliated licensees, as described in the disclosure at the bottom of every page of this site.

4. Who may use the site

You must be at least 18 years old and able to enter into a binding agreement. If you contact us about a property, you confirm that you own it or are authorized to act for the owner.

5. Information you give us

When you book a call or subscribe to our newsletter, you give us information such as your name, contact details, and any property details you choose to share. By doing so:

  • you confirm the information is accurate and that you have the right to share it; and
  • you agree we may contact you about your inquiry by email, phone, or text. For our newsletter, we use double opt-in (you confirm before we add you), and you can unsubscribe at any time.

How we collect, use, and protect your information is described in our Privacy Policy.

6. Acceptable use

Please use the site lawfully. You agree not to:

  • scrape, harvest, or use automated tools to collect data from the site;
  • disrupt or overload the site, or try to gain unauthorized access to it or its systems;
  • use the site for any unlawful, infringing, or fraudulent purpose; or
  • impersonate anyone or misrepresent who you are or who you’re affiliated with.

7. Our content

The site’s content — its text, design, the Filos Stays name and brand, and its imagery — is owned by or licensed to us and protected by law. Some images on the site are illustrative and were generated with artificial intelligence; they do not depict specific properties we manage.

We give you permission to view the site for your own personal, non-commercial use. You may not copy, reuse, redistribute, or sell any of the content without our written permission.

8. Links and third-party services

The site links to and includes services run by others — for example, Cal.com, which we use for booking calls. Those services have their own terms and privacy policies, and we’re not responsible for them. A link to another site isn’t an endorsement of it.

9. The site is provided “as is”

We work to keep the site accurate and available, but we provide it “as is” and “as available.” We don’t warrant that it will be error-free, uninterrupted, or secure, or that its content is complete or current. To the fullest extent the law allows, we disclaim the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

TO THE FULLEST EXTENT KENTUCKY LAW ALLOWS, FILOS STAYS AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND CONTRACTORS WON’T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WON’T EXCEED ONE HUNDRED DOLLARS ($100).

Nothing in these terms limits any liability that Kentucky law does not allow to be limited or excluded.

11. Governing law and disputes

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws rules.

The state and federal courts located in Jefferson County, Kentucky have exclusive jurisdiction over any dispute relating to the site or these terms, and you consent to that jurisdiction and venue. TO THE EXTENT THE LAW ALLOWS, YOU AND WE EACH WAIVE ANY RIGHT TO A JURY TRIAL IN SUCH A DISPUTE, AND AGREE THAT ANY DISPUTE WILL BE BROUGHT ONLY ON AN INDIVIDUAL BASIS — NOT AS PART OF A CLASS OR REPRESENTATIVE ACTION.

12. General

If any part of these terms is found unenforceable, the rest stays in effect. If we don’t enforce a part of these terms right away, we don’t give up our right to do so later. These terms are the entire agreement between you and us about your use of the site.

13. Changes to these terms

We may update these terms from time to time. The “last updated” date above shows when they last changed. Changes take effect when we post them, and continuing to use the site means you accept the updated terms.
